QUEENSLAND

Classified as restricted items under the Weapons Act 1990 Section 67 of the Act - A person must not, without reasonable excuse, possess or acquire a restricted item.

A side-handled baton or other similar device that, consists of a baton, staff or rod; and is made of a hard substance; and has fitted to 1 side a handle (whether or not permanently fixed).

Imitation firearm (A) means something that, regardless of its colour, weight or composition or the presence or absence of any moveable parts, substantially duplicates in appearance a firearm but is not a firearm; and (B) includes something that the registrar declares to be an imitation firearm under section 31.

An imitation firearm that is an imitation of a pistol is taken to be a pistol; and an imitation firearm that is an imitation of a prohibited firearm is taken to be a prohibited firearm.

VICTORIA

The Control of Weapons Act 1990 divides non-firearm weapons into three basic categories; prohibited weapons, controlled weapons and dangerous articles. Only certain licences and permits enable a person to purchase, possess, carry or use batons whilst working in the private security industry.

A person must be able to demonstrate all of the following four requirements in order to work with batons.

Requirement 1: Licence/Permit Type A person must hold (1A) an individual operator licence or (1B) A business licence or (1C) a temporary visitor permit.

Requirement 2: Activity A person's licence or permit must authorise them to perform one of the following. (2A) Crowd controller or (2B) Security guard activities or (2C) Bodyguard activities. 

Requirement 3: Training (3A) The individual licence or permit holder must also have completed the unit of competency 'Control Persons Using Baton' (CPPSEC3014A).

Requirement 4: Permission from your employer (4A) The individual licence or permit holder must receive written approval from their employer before they can purchase, posses, carry, or use a baton as part of their job.

A person must be able to demonstrate both of the following two requirements in order to lawfully use handcuffs when working in the private security industry.

Requirement 1: Training (1A) The individual licence or permit holder must have completed the unit of competency 'Restrain Persons Using Handcuffs' (CPPSEC3015A).

Requirement 2: Permission from your employer (2A) The individual licence or permit holder must receive written approval from their employer before they can use handcuffs as part of their job.

SOUTH AUSTRALIA
Sale of - Extendable batons

A licensed security agent who holds an H6 firearms licence and carries on the business of guarding property is exempt from the offence of possession and use of an extendable baton only under certain governed requirements.

The exemption under the act allows for the business owner or individual to make a purchase of batons, only security agents who hold a H6 firearms licence may purchase, possess and use batons during the course of there duties.

Sale of - Training guns.

The Act and Regulations expressly exclude a number of items from being regulated imitation firearms. Moulded imitation firearms (training guns) items resembling a firearm which do not contain a receiver or a mechanism which imitates the loading mechanism or firing mechanism of a firearm are considered to be exempt from regulation in South Australia.

Therefore, a person wanting to purchase a training gun can do so without a licence, permit or approval as long as they have a lawful purpose.

WESTERN AUSTRALIA

Section 26 of the Security and Related Activities (Control) Act provides for a security officer's licence to be endorsed to permit the carriage of a baton while engaged in activities authorised by the licence.

Security Officers may be approved to carry batons only when endorsed to do so. Without a specific licence endorsement, no weapons are to be carried by a Security Officer while he or she is performing licensed activities.

Purchaser must complete baton training (control person using baton) with an approved registered training provider and obtain a baton certificate before applying for a baton endorsement.

A permit or licence is not required in Western Australia to possess an imitation firearm, just a lawful reason and purpose, classified as a controlled weapon within the weapons regulations 1999, schedule 2.

Ballistic resistant protective clothing is controlled under Section 557 I of the Western Australia Criminal Code.

In this section of the Act: Bulletproof clothing means a protective jacket, vest, or other article of clothing, designed to resist the penetration of bullets or other missiles discharged from firearms.

The Commissioner, by a written permit, may permit a person or a class of persons to possess bulletproof clothing on any conditions (to be specified in the permit) that the Commissioner thinks fit.

TASMANIA

Baton handcuff endorsement: To carry a baton and/or handcuffs you must have a full licence (not provisional) with security general guarding, security guarding with dog or security guarding with firearm activity added to the licence.

To apply to have the endorsement added to your current licence you need to complete an Application to amend registered details (employee or agent individual) form (pdf)

Complete the baton training course units. The course units will need to be completed each year to continue to hold the endorsement.

An imitation firearm is defined under the Act as an article of any material or colour that is a copy or reproduction of a firearm or has the appearance of a firearm and could reasonably be mistaken for a firearm.

It is the size and features of the item which make it an imitation, not the colour. If it is clearly a toy it is not an imitation firearm.  If it could reasonably be taken to be a firearm then it is an imitation firearm.

You must be the holder of a firearms licence to possess an imitation firearm (other than a toy).  The only ‘genuine reason’ to possess imitation (or replica) firearms is collection. You must have the licence of the appropriate category for the type of imitation firearm you wish to possess.
